This Privacy Policy applies to our collection, use and disclosure of personal information in connection with our products and services offered in Canada, excluding Québec. We do not currently offer our products or services to residents of Québec or otherwise conduct business in Québec. If you are located in Québec, please do not submit an application for, register for, or otherwise use our products or services.
INH respects the privacy of the users and is committed to respecting and protecting your privacy, that of your deceased loved one, and their estate. INH recognizes an individual’s right to privacy and is committed to maintaining the accuracy, confidentiality, and security of personal information in its custody. This commitment is reflected in our internal policies, safeguards, and practices to ensure compliance with relevant laws and regulations with respect to the information entrusted to us.
INH adheres to maintaining the highest standard of quality, transparency, and accountability by developing policies and procedures about the collection, use, and disclosure of information with our Deceased Notification Services that align with federal, provincial, and industry standards.
Policy Application
INH complies with all applicable provisions of Canadian federal and provincial privacy legislation in the jurisdictions where Company does business.. We have implemented the Personal Information Protection and Electronic Documents Act (PIPEDA), which set the ground rules for how private-sector organizations collect, use, and disclose personal information during commercial activity.
This policy applies to information we collect through the Website and in communications with you.
- Definitions
In this Privacy Policy, we will use the following terms:
- “us”, “we”, “our” or “INH” refers to InheritNOW Financial (Canada) ULC;
- “you”, “your”, “yourself” refers to you as an individual, relative, next-of-kin, heir, beneficiary, executor, administrator, representative or in any other capacity regarding a Decedent and/or the Decedent’s Estate.
- “Decedent” refers to the deceased individual whose estate is the subject matter of a potential inheritance advance and submittal of information on our Website and to us in communications from you.
- “Decedent’s Estate” means the real and personal property of the Decedent at the time of death subject to inheritance.
- “Estate Information” means any information about yourself, the Decedent, and/or the Decedent’s Estate, such as the Decedent’s name, address, phone number, date of birth and, as applicable, date of death, Social Insurance Number, company name and account number, and information regarding any formal or informal probate or similar court or administrative process involving the Decedent’s Estate, along with the name and contact information of the personal representative of Decedent’s Estate (and/or executor, administrator, trustee or similar roles).
- “Inheritance Advance Product” means InheritNOW’s business of purchasing beneficial interests in estate in exchange for cash payments.
- “Website” means the “InheritNOW” website which operated by InheritNOW Financial (Canada) ULC and located at www.InheritNOW.com . The term “Website” as used in this Privacy Policy refers solely to the Canadian version of “InheritNOW” website and does not include any other websites that are not hosted, owned and/or operated by InheritNOW Financial (Canada) ULC, such as any of the INH’s domestic or international affiliated companies and the United States version of the Website operated by a separate US-based entity.
- “Cookies” are small text files offered to a user’s computer by web servers that keep track of the user’s browser as a website is navigated;
- “Personal Information” is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include any information about or relating to a Decedent, except where such information is subject to the protection of applicable Canadian privacy laws.
- About Us
We are an inheritance advance company. Our primary business is purchasing beneficial inheritance interests in Decedent’s Estates. Customers irrevocably sell, assign and transfer a portion of their beneficial interest in a decedent’s estate in exchange for a lump sum immediate cash payment. We collection Personal Information and Estate Information to evaluate whether to enter into a transaction with a customer and to communicate with our customers throughout the estate administration until distributions are made by the Estate, thereby satisfying the assigned portion.
- How We Collect Your Personal and Other Information
The Inheritance Advance Product includes the disclosure and sharing of Estate Information and Personal Information including certain information about Decedents and/or a Decedent’s Estate that is voluntarily submitted by you. By providing information to us concerning an estate or another individual, you confirm that you are authorized to provide that information to us for the purposes described in this Privacy Policy. We compile and assemble the information provider by you, along with public record information, with respect to each Decedent’s Estate.
We primarily collect personal and other information regarding yourself, Decedent, or a Decedent’s Estate from the following sources:
- Directly from you including Personal Information regarding yourself and other Estate Information that you voluntarily disclose;
- Public records from or provided by federal, state, country and other government offices, public registries, and other sources as may be permitted by law;
- Information about you or a Decedent that is provided to us by third parties that are either responsible for obtaining your prior consent to provide such information to us or otherwise permitted to disclose such information under applicable law;
- Automatic collection technologies help us to improve our Services and to deliver a better and more personalized experience. Where required, we obtain opt-in consent before using any technology that allows you to be identified, located, or profiled.
We limit the collection of personal information regarding you, Decedent and Decedent’s Estate to include only what is reasonably necessary to provide our Inheritance Advance Product.
WHILE WE DESIGN OUR FORMS TO COLLECT ONLY THE INFORMATION NECESSARY TO PROVIDE THE INHERITANCE ADVANCE PRODUCT, WE CANNOT CONTROL THE INFORMATION YOU CHOOSE TO PROVIDE US. ANY INFORMATION YOU VOLUNTARILY INCLUDE IN YOUR SUBMISSION OR IN ANY COMMUNICATIONS WITH US WILL BE RECEIVED AND RETAINED BY US, REGARDLESS OF WHETHER IT WAS REQUESTED OR REQUIRED.
If you call us, we may record and retain the recording of your call to ensure the accuracy of our discussions and for quality control and record keeping purposes.
- The Estate and Personal Information We Collect
The personal information described in this section is collected, used, and disclosed in accordance with Personal Information Protection and Electronics Documents Act, and, where applicable, provincial legislation including British Columbia’s Personal Information Protection Act (BC PIPA), and Alberta’s Personal Information Protection Act (AB PIPA).
Our records regarding a Decedent’s Estate may contain the following information:
- Identifying information: Decedent’s name, previous name(s), date of birth, current and previous addresses and telephone numbers, and date of death(as applicable), relationship data (next of kin, family relation). In addition, identifying documentation for you, such as a driver’s license, passport or provincial ID.
- Contact information: contact information regarding yourself, such name, email address, telephone number and postal address, for the purposes of responding to inquiries or requests or those of a Decedent’s Estate, communicating with you or the Decedent’s Estate, and verifying your or the Decedent’s identity, death and related information pertaining to the Estate.
- Public records: information that may be helpful to confirm and/or verify (a) the identity or authority of you (b) the identity and death of the Decedent, including death certificates and documents related to the administration of a Decedent’s Estate; and (c) information regarding any formal or informal probate or similar court or administrative process involving the Decedent’s Estate.
- Information Relating to Debts and Assets of a Decedent’s Estate: certain account-level information, such as creditors’ names, amounts of debts, loans, credit cards, utilities or other service accounts, and other related information pertaining to the liabilities of Decedent’s Estate. In addition, information relating to and identifying assets of a Decedent such as real property and land, bank accounts and cash, investment and brokerage accounts, securities and other financial instruments, business interests, intellectual property, digital assets, insurance proceeds payable to a Decedent’s Estate, personal property and valuables, and other refunds, rebates or amounts owed to Decedent or Decedent’s Estate. By disclosing this information to us you represent that you are permitted to do so under Canadian legislation, including any applicable exception for disclosure without consent (i.e. for the purpose of collecting a debt owed by the individual).
You may access, correct, or request the deletion of the personal information described in this section by contacting our Privacy Officer via email at support@inheritnow.com. INH will honor all such requests without delay but no later than 72 hours.
We also collect other information you have provided related to a Decedent’s identity and death, which we maintain for quality control and authentication purposes. This information may include your or the Decedent’s name and contact information, copies of, or information from, a decedent including, copies of death certificates and similar publicly available information.
The Estate Information that we collect is not intended to contain, and we do not collect or process, information related to medical histories, or race, creed, ethnicity or political affiliations of you or a Decedent.
We also collect:
- Statistics or aggregated information: Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
- Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for, page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page. Where this technology requires you to be identified, located, or profiled, we obtain your opt-in consent before use and you may manage your preferences on the Website as required under Canadian privacy laws.
| If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information. - How We Use Your Personal or a Decedent’s Estate Information
We limit our use and sharing of the Estate Information we collect for those purposes which have been disclosed to and consented to by you in this Privacy Policy. We require you to have either obtained the appropriate consent to disclose, share or use any Estate Information with us or have a legal permissible purpose to make such disclosure under Canadian legislation. We limit the use of personal information obtained from us to purposes set out in this Privacy Policy or that otherwise are permitted by law.
We use and disclose Estate Information in the following circumstances:
(a) to provide our Inheritance Advance Product to you;
(b) verify information and communicate with you and/or representatives of a Decedent’s Estate;
(c) facilitate the performance of, and administer, enforce, protect, or defend our rights and obligations under, any agreement or arrangement between you and us;
(d) to fulfill our obligations under Canadian legislation regarding data privacy, security and other applicable and/or relevant legislation (such as, a request to initiate an investigation);
(e) to act in respect of an emergency that threatens the life, health or security of an individual or for other purposes as permitted or required under applicable Canadian privacy legislation;
Please note that we will only use your information for direct email marketing campaigns from our affiliates or other third parties where you have provided separate, express consent for such purposes. This consent is separate from your consent to receive communications necessary to provide the Deceased Notification Services, and you may withdraw it at any time, with no cost to you.
We may engage third parties to assist us with infrastructure maintenance and support. These service providers are prohibited from using your Personal Information and Estate Information for any purpose other than to provide this assistance and are required to protect Personal Information and Estate Information disclosed to or by us and to comply with the general privacy principles described in this Privacy Policy as well as respect Canadian privacy legislation. Some of these service providers may be located outside of Canada, and in such cases, we conduct an assessment to confirm it will receive the proper confidentiality necessary to safeguard personal and sensitive information. As a result, Estate Information may be subject to local laws in foreign jurisdictions, which may permit law enforcement, government, or national security authorities to have access to such information in certain circumstances.
Our business does not involve the granting or extension of credit. We do not use your information or the Estate Information obtained in connection with the determination of any individual’s eligibility for credit, insurance, or employment, or to assess the risks associated with any business transactions (including tenant screening) with an individual.
- Information Security & Privacy Officer
We take the protection of your Personal Information and any Decedent’s Estate Information seriously. We have appointed a Privacy Officer to ensure compliance of this Privacy Policy and in compliance with Canadian privacy legislation. Anyone who wishes to address INH’s Privacy Policy or exercise any privacy rights can contact the Privacy Officer via email at support@inheritnow.com. The Privacy Officer will receive and respond to complaints or inquiries about organizational policies and practices relating to the handling of personal information and confidentiality. INH takes all concerns seriously and will investigate the matter. If you are not satisfied with our respond, you may contact the Office of the Privacy Commissioner of Canada.
Furthermore, we have implemented a security program that is aligned with industry best practices that is consistent with our safeguarding obligations under Canadian privacy law. We have adopted procedures to secure storage of information and are committed to working with our Subscribers to protect the security of Estate Information during any transfer to or from us. We have also instituted several safeguards to identify and prevent the fraudulent use of such information. We use firewall technology to protect data from intruders and have implemented other safeguards to secure information such as passwords, encryption, antivirus software and physical security measures. Only our authorized employees and representatives will have access to your or a Decedent’s Estate Information and only to the extent necessary to perform their job functions. All such employees will have received appropriate training as to the privacy and data protection requirements applicable to our business. In the event of a privacy incident involving your personal information that poses a risk of serious harm, we will notify the affected individual, maintain a report of such incident and report to the applicable privacy regulator as required by law.
- Sharing Your Personal Information with our Affiliates

We may share your personal information with our affiliates operating in Canada and the United States where necessary for the purposes specified in this Privacy Policy. Before transferring personal information outside of Canada, we conduct an assessment to confirm that the affiliate has the appropriate level of security in place in accordance with Canadian privacy legislation and we ensure that the affiliates are protecting the information accordingly and in compliance with PIPEDA’saccountability principle. As such, Estate Information may also be subject to the laws of the United States, where applicable. A list of our affiliates in the US is set forth below and may be updated from time to time.

- Retention of Your and a Decedent’s Estate Information
We may retain the categories of personal data described in this policy in our database for as long as necessary to provide our Inheritance Advance Product, operate our organization, comply with our legal obligations, resolve disputes, safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain Personal Information. We will delete Personal Information provided to us about a Notifier or a Decedent’s Estate that is no longer needed in connection with our Inheritance Advance Product, except where longer retention is required to comply with a legal obligation or resolve a dispute as may be permitted or required under applicable Canadian privacy legislation.
- Accuracy of and Access to Estate Information
We attempt to maintain Estate Information as accurate, complete, and up to date as necessary for purposes of providing our Inheritance Advance Product; however, all Estate Information is provided to us by you and other third parties and, accordingly we cannot and do not guarantee or make any representation as to the accuracy, completeness, or timeliness of any Estate Information. You are requested to maintain the accuracy of the information provided by you, and to inform us of changes to that information as soon as possible. You have the right to access your Personal Information and the corresponding Decedent’s Estate Information, to verify its accuracy and completeness, and to obtain details about the use and disclosure of such information, except where limited by law. In connection with our operations, we provide access and/or correction requests and addresses any other questions or concerns in accordance with applicable Canadian privacy law. For information on how to access your or a Decedent’s Estate Information or request a copy, or dispute or update any Decedent’s information, please contact us as provided below.
When gathering Estate Information, we work with you and representatives of a Decedent’s Estate to increase their awareness of the importance of providing only information that is accurate and up to date. However, we cannot alter the information provided by you or third parties, unless the information is determined to be wrong, incomplete, or otherwise inaccurate. If you do not agree with the accuracy of the information we have on file, we have procedures to ensure that such information is verified, and, where appropriate, amended or corrected.
11. Your Privacy Rights
You may exercise the following rights with respect to your personal information, subject to applicable Canadian privacy legislation:
- If you are a resident of Canada, PIPEDA, and where applicable, provincial legislation such as the Personal Information Protection Acts in British Colombia (“BC PIPA”), and Personal Information Protection Acts in Alberta (“AB PIPA”) provide individuals with the following rights:
- Request access to your personal information held by INH and learn how it has been used or shared;
- Request that we delete personal information about you that we maintain, subject to certain exceptions under applicable privacy law (i.e. where retention is required to comply with a legal obligation to resolve a legal or administrative dispute);
- Correct inaccuracies in your personal information by considering the information’s nature processing purpose;
- Data portability; request that your personal information be provided to you or transferred to another organization in a structured technological format and request that we cease disseminating or sharing your personal information, where previous consent was granted;
- Opt-out of personal data processing, at no cost to you, for targeted advertising;
- Withdraw consent to the collection, use, or disclosure of your personal information, subject to legal or contractual restrictions
We do not sell or share your Personal Information to third parties for cross-context behavioral advertising or targeted advertising purposes.

This policy supports INH’s compliance with Canada’s Anti-Spam Legislation (“CASL”).
CASL is intended to protect consumers from the misuse of digital technology, including spam. In all communications, we will include the double-opt in feature and clear instructions on how to subscribe, and unsubscribe, where applicable, if an individual no longer wishes to receive future e-mails from INH, at no cost.
